Please read the following terms and conditions carefully as your use of the service is subject to your acceptance of and compliance with the following terms and conditions ("Terms"). The Site allows you to browse, select, and purchase Clothing and Accessories (“Goods” or “Products” or “Services”).

By subscribing to using any of our services and any purchases made by you through the website shall signify your acceptance of the supply terms and your agreement to be legally bound by the same. In addition to the foregoing, you shall also be bound by the terms of use of the website or additional terms of service which are displayed with the selection of the product. If there is any conflict between the supply terms and the additional terms, the additional terms shall take precedence in relation to that sale.

In these Terms, references to "you" "User" shall mean the end user accessing the Website, its contents, and using the Services offered through the Website. "Service Providers" mean independent third-party service providers, and "we," "us," and "our" shall mean KSushT.

If you visit, use, or shop at the site (or any future site operated by the company), you accept these terms and conditions. In addition, when you use any current or future services of the company or visit or purchase from any business affiliated with the company or third-party vendors, whether or not included on the site, you will also be subject to the guidelines and conditions applicable to such service or merchant. If these conditions are inconsistent with such guidelines and conditions, such guidelines and conditions will prevail.

Our store is hosted on Shopify. They provide us with the online e-commerce platform that allows us to sell our products to you.

1. Collection of Personally Identifiable Information and Other Information

Our primary goal in doing so is to provide you with a safe, efficient, smooth, and customized experience. We do use your contact information to send you offers based on your previous orders and your interests.

2. Use of Demographic/Profile Data/Your Information

With your consent, we will have access to your SMS contacts in your directory, location, and device information, and we may request you to provide your PAN and Know-Your-Customer (KYC) details to check your eligibility for certain products/services, including but not limited to credit and payment products, etc., to enhance your experience on the platform and provide you access to the services being offered by us, our affiliates, or lending partners. Access, storage, and use of this data will be in consonance with applicable laws. You understand that your access to these products/services may be affected in the event consent is withdrawn.

In our efforts to continually improve our product and service offerings, we and our affiliates collect and analyze demographic and profile data about our users' activity on our Website.

We identify and use your IP address to help diagnose problems with our server and to administer our Website. Your IP address is also used to help identify you and to gather broad demographic information.

Once your information is in our possession, we adhere to strict security guidelines protecting it against unauthorized access.

We provide all users with the opportunity to opt out of receiving non-essential (promotional, marketing-related) communications from us on behalf of our partners and from us in general after setting up an account.

By using the Website and/or by providing your information, you consent to the collection and use of the information you disclose on the Website in accordance with this Privacy Policy, including but not limited to your consent for sharing your information as per this privacy policy. If you disclose any personal information relating to other people to us, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.

USER ACCOUNT, PASSWORD, AND SECURITY:

You may be required to register with in order to access certain services or areas of the Site. With respect to any such registration, we may refuse to grant you and you may not use a user name (or e–mail address) that is already being used by someone else; that may be construed as impersonating another person; that belongs to another person; that personally identifies you; that violates the intellectual property or other rights of any person; that is offensive; or that we reject for any other reason in our sole discretion.

Your username and password are for your personal use only. If you use the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. 

KSushT cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

NO COMPENSATION POLICY:

If the quality of any products, services, information, or other material purchased or obtained by you through the website did not meet your expectations, no compensation will be given as per the Return and Exchange policy. The customer cannot request compensation for any reason, including but not limited to: any variation in the finish or appearance of the final product; any delay in delivery caused by unforeseen circumstances; any special, incidental, indirect, or consequential damage of any kind caused by a product; missed opportunities to avail certain discounts; any issue with our Delivery partners or their personnel; any voucher which got deactivated due to the end of the expiry date; unavailability of items which the customer tried to purchase etc. Unreasonable and unlawful requests for compensation will be treated as a loss to business cases. KSushT holds the rights to cancel orders and block accounts of such customers without any prior notice.

PRODUCT VARIATION:

KSushT hereby disclaims any guarantees of exactness as to the finish and appearance of the final Product as ordered by the user as the quality of imagery cannot be taken as a final representation. The quality of any products, Services, information, or other material purchased or obtained by you through the Website will be as per the company standards.

KSushT strives to display as accurately as possible the colors of the products shown on the Site. However, because the colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate.

PRICING:

Prices for products are described on our Website and are incorporated into these Terms by reference. Prices are in Indian rupees for the Indian market. Prices, products, and Services may change at the discretion of KSushT. In accordance with brand guidelines, prices might change when the stocks are replenished. 

While we strive to provide accurate product and pricing information, pricing or typographical errors may occur. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, we may, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation.

CREDIT CARD DETAILS:

You might be required to provide your credit or debit card details to the approved payment gateways while making the payment. In this regard, you agree to provide correct and accurate credit/debit card details to the approved payment gateways for availing of services on the website. You shall not use the credit/debit card that is not lawfully owned by you. The information provided by you will not be utilized or shared with any third party unless required in relation to fraud verifications or by law regulation or court order. You will be solely responsible for the security and confidentiality of your credit/debit card details. KSushT expressly disclaims all liabilities that may arise as a consequence of any unauthorized use of your credit/debit card.

 

TERMINATION:

KSushT may suspend or terminate your use of the Website or any Service if it believes in its sole and absolute discretion that you have breached any of the Terms.

If you or KSushT terminates your use of the Website or any Service, KSushT may delete any content or other materials relating to your use of the Service, and KSushT have no liability to you or any third party for doing so.

You shall be liable to pay for any Service or product that you have already ordered till the time of Termination by either party whatsoever.
